OK. This is what creative financing is about. This is an actual e-mail from a Realtor/student who attended the seminar and had a question about a particular situation ...

My client's situation is a lot of what is happening here in Michigan. She bought the house two years ago for $185,500. In today's market, with a regular sale, she will be hard pressed to get 180,000. She has a mortgage balance of $180,100 with an interest rate of 5.75%. She would be thrilled to get $185,000 for the house - to be able to walk away from it.

My Response:
First, you shouldn't make the new note lower than the mortgage now in place - always higher.
Second, examine the mortgage paperwork/deed of trust, to see if the lender puts any restrictions regarding transfer of the property. Mainly, if the lender specifically prohibited using a contract for sale.
You must do all deals legally so nobody gets in the trouble. There is always a way to go around all restrictions if you know how.
Your case is a good example of a seller just wanting out and you making a decision - I can get the property for a song and make monthly income myself or let the seller make the money.
Here are my suggestions - think about the numbers below ...
- Selling price $199,995
- $14,995 down, with a new note and new mortgage of $185,000, amortized over 30 years at 7.75% - P + I $1325.36
- Plus T + I $373.51 = monthly payment of $1741.37
- Giving YOU or the seller income of $141.79 a month.
In 5 years (contract for 5 years) this new note (yours or the seller's) gets paid down to $175,659, the mortgage on the property estimated $171, 866 - I don't know amount and date of start of the mortgage.
Anyway leaving extra income of $3,793 after buyer refinances. All costs to be paid by the buyer, when buyer refinances.
So the total income for you or the seller is $141.79 times 60 months which equals $8,507.40, plus $3,793, plus $14,995 down payment - total profit /for somebody/ is $27,295.40.
The first deal you'll do, will seem complex. After the first deal the next hundred are easy.
Make sure your laws allow for a quick eviction if buyer is in default (buyer's status to change from a buyer to the tenant if the buyer is in default).
Make sure the buyer signs a note of $185,000, not just the contract for sale.
Make a provision in the contract if buyer cannot refinance in 5 years, what will happen - extend the contract or leave the property. Also include a provision for what happens if real estate values are below today's values.
Things you can play with, adjust up and down - selling price, down payment, interest, length of mortgage, extra notes if buyer doesn't have the full down payment today.
You said it correctly - the buyer's monthly payment is the key. All that matters is what the buyer can afford to pay monthly - nothing else.
Make sure you pre-qualify the buyer better than a lender would do, but don't let the buyer know that he is being totally pre-qualified. Ask questions, lots of them - what do you do for living, your spouse, what's the monthly income, how many kids you have, did you own a home before, why you cannot qualify for a loan etc.,etc.,etc. You want the best buyer possible to buy the property, so you don't have problems.
Always judge the numbers depending on what your area can bear. Practically speaking, the buyer won't care if the selling price is $229,000, as long as he can handle the down payment and the monthly payment. So you could go higher with the note and lower with the interest rate or the years of amortization, so when 5 years is over, you or the seller can make a ton of money ..., $62,000 instead of $27,295.
Either way, if you start making sellers rich, the word will spread around and you'll do a ton of business or you'll buy lots of homes yourself.
You have no competition, not many agents know this stuff, if any at all. There is no place in existence where they can learn this magic. No books, no teachers, no web sites.
Probably I forgot a few things, like a collection company to accept the buyer's payment and disbursement to the proper parties. You can use title company's or incorporate and create your own - that way you are totally in control.
In my mind, $62,000 beats $15,000 commission. In view of that, a small investment for our seminar and a few of my books can repay nicely.
I started to do those deals when I was licensed and that's how I got the name "Mr.Real Estate." Maybe you are the future Mrs.Real Estate in Michigan?
I forgot - very important, when buying homes for investment ... ALWAYS state - in writing - that you a Realtor and you are buying the property for profit. On the O&A, it is a must.
Remember, if you get lots of listings or own lots of homes, the other "friendly" Realtors will be shooting at you. They don't necessarily want to do it, but they don't want you to be rich either.
If you do a seminar for FSBO's using this example above, the for sale by owners and future home sellers will go absolutely wild.
Now you have just seen a real life situation and the solution to the problem. But, you need to learn much more ...
Everything must be perfectly legal in your state. And that's not easy because there 50 states, and thousands of counties that have their own laws, regulations, restrictions ... and ambiguities.
Regarding the example above, subsequently, there was more to this transaction - which we'll discuss during the teleclasses.

Making the numbers work means creating a "win-win" situation for all parties involved. When YOU learn the solutions, you'll be the most sought after agent around.
The sellers has several options before they lose their home. Learn these options and use them! Losing a home or getting a charge off or Deed in Lieu on their credit report is NO option.
There is a creative solution for every scenario, no matter how desperate it looks. If the seller is going to lose money with you, he or she doesn't need you!
So, this teleseminar is NOT going to teach you about foreclosures or short sales as you have come to know them. You really don't want the seller to lose everything. Anybody can do that ... except OUR students!
